SOUTH AFRICAN TOURISM VIDEO CONTEST OFFICIAL RULES
ELIGIBILITY:
The South African Tourism Video Contest ("Contest" is open only to organized youth soccer teams composed of legal residents of the 50 United States and District of Columbia, ages 8 through 14. Teams may have a minimum of 10 members and a maximum of 15 members. Teams must be affiliated with organized leagues or organizations such as American Youth Soccer Organization, US Youth Soccer National League, Metro Youth Soccer League and similar organizations. Teams managed, coached or supervised by employees of South African Tourism ("Sponsor"), the government of South Africa and any entities affiliated with the government of South Africa or of entities involved with the development, implementation and administration of the Contest and immediate family members (spouses and parents, siblings and children and spouses of the foregoing) and members of the same household of such individuals are not eligible. Void where prohibited.
CONTEST PERIOD:
Contest begins 09/25/09 at 12:01 AM ET and ends 12/13/09 at 11:59 PM ET.
REGISTRATION:
Authorized team coaches or managers or parent/legal guardians of team members, who are legal US residents age 21 or older, will be required to fully complete and timely submit on behalf of an eligible team a Registration Form to be submitted with the video entry.
HOW TO PARTICIPATE:
Eligible teams will be asked to go to
www.southafrica.net and access the contest page to view videos of the Diski dance. Each team will then be required to perform and record their version of the dance using only the Diski music available in MP3 format. The video should involve the entire team and the dance, costumes and setting should incorporate the dual themes of South Africa and soccer and reflect the creative thinking of the team members. The video may be in color or black and white and must be approximately 60 seconds. It is strongly recommended that the individual submitting the entry obtain from the person making the video (the "videographer") a dated and signed statement granting the right to use the video in the Contest and as specified in these Official Rules and retain such statement for submission to Sponsor as may be required by
JUDGING OF ENTRIES below.
HOW TO ENTER:
Authorized team coaches or managers or parents/legal guardians of team members who are legal U.S. residents age 21 or older should access the Registration Form and provide all the information requested. Follow instructions to upload the prepared video and click on the link to submit the video and completed Registration Form no later than 11:59 PM ET on 12/13/09. Entry will not be valid without the individual making the submission checking (1) a box affirming his/her personal eligibility; the eligibility of the individual team members; the affiliation of the team with the named league or organization and (2) a box affirming that the parent of each team member has consented to the participation of his/her child in the video and Contest. Limit of one entry per team. A child may participate only with one team.
JUDGING OF ENTRIES:
Each eligible entry will be judged by representatives of the Sponsor on the basis primarily of its creativity and secondarily on its adherence to the dual themes of South Africa and soccer. Five Finalists will be selected and the individuals submitting the entries will be notified by express mail on or about 12/20/09. Each Finalist Team will be required to complete and submit in a time to be specified the following documentation: (a) an Affidavit of Eligibility and Liability Release by the individual submitting the entry; (b) a statement of the names, dates of birth and addresses of the team members; (c) a written consent from the parent or legal guardian of each team member to the participation of their child in the video and contest and a grant to the Sponsor of an unrestricted license to use in any media at any time or times the video, in its original or edited form, or any still, image or photo in its original or edited form taken from the video, without any notice, review or approval of such use or uses; and (d) the written grant to Sponsor by the videographer of the video of the right to use the video in the Contest and as stated in the Official Rules (collectively "the Documents").
Upon timely receipt of the completed Documents, the Finalist entries will be rejudged by Sponsor on the same criteria as stated above. ( If for any reason a Finalist fails to timely return the completed and signed Documents, that entry will be disqualified.) The Finalist selected as the Grand Prize winner will be notified by express mail on or about 1/15/10.
GRAND PRIZE:
The Grand Prize is a trip to South Africa for the winning team: the manager or coach submitting the entry and one guest and the fifteen team members and a parent or legal guardian of each member. The trip will be for approximately 8 days/7 nights and will take place in March 2010. The trip consists of round trip economy air travel from major international airport nearest city or town of team to Johannesburg, hotel accommodations (double rooms), three meals daily, sightseeing including possible visits (with travel) to other cities and/or a national game park and the opportunity to play a soccer match against a South African youth soccer team, subject to availability and approval, in the World Cup Stadium. Approximate Retail Value of prize for each individual and guest is USD $6,000 per person.
PRIZE RESTRICTIONS:
Trip must be taken on dates and at times determined by Sponsor. No prize transfer by any individual except at sole discretion of Sponsor. No cash or other prize substitution except Sponsor at its sole discretion may substitute prize or any part thereof for one of comparable value. Taxes on prize and any expenses related to the acceptance and use of the prize not specifically stated are the sole responsibility of each team member and the team manager or coach. Individuals taking the trip are responsible for having valid passports and any other required documentation. Travel guests must be legal U.S. residents age 21 or older. Each travel guest must complete, sign and return a Liability Release and, where lawful, a Publicity Release within a time specified by Sponsor.
GENERAL CONDITIONS:
By participating in the Contest, each participant (and if a minor, their parent or legal guardian) agrees: (a) to these Official Rules and the decisions of the Sponsor and its authorized agents, which decisions shall be final; (b) to release, discharge, indemnify and hold harmless Sponsor, the Government of South Africa, their agents and their respective officials, directors, officers and employees (""Contest Entities"") from any and all liability resulting, in whole or in part, directly or indirectly, from participation in the Contest and the acceptance and use of a prize, including but not limited to liabilities for personal injury, death, damage to or loss of property, or infringement of an individual's right to privacy or right of publicity; (c) that the Sponsor has made no warranty of any kind, express or implied, directly or indirectly, regarding the prize or any element of the prize; (d) if a prize winner, that the winning video will be deemed a Work Made for Hire under the Copyright Laws of the United States, but if it cannot be so considered, winner irrevocably assigns and transfers to Sponsor all right, title and interest in the video in the United States and worldwide; and (e) if a prize winner to the use for advertising and publicity purposes in all media of his/her name, images from the winning video, any photographs, video or film taken on the Grand Prize trip, all without prior notification, review or consent or additional compensation, except where prohibited by law.
LIMITATIONS OF LIABILITY:
Contest Entities are not responsible for late, lost, illegible, damaged or misdirected videos or entries, mail, e-mail regardless of the cause; or for any computer, hardware, software, technical or other problems or errors, including web site unavailability or the failure to capture any submitted material or the loss of such material; nor are they responsible for any incorrect or inaccurate information or for the loss or theft of personal information, whatever the cause thereof. If for any reason the Contest is not capable of running as planned or intended, regardless of the reason, which Sponsor at its sole discretion determines could corrupt or affect the fairness or integrity of the Contest, Sponsor reserves the right to terminate, cancel or modify the Contest and to proceed with the Contest in a manner which Sponsor, at its sole discretion deems fair and appropriate; and in such event notice thereof will be posted on
www.southafrica.net/dance. Sponsor reserves the right to disqualify entries or contestants it deems to be not in compliance with these Official Rules.
GOVERNING LAW/DISPUTE RESOLUTION:
This Contest shall be governed by and interpreted under the laws of the State of New York without regard to the conflict of laws doctrine of any jurisdiction; and any disputes, claims or causes of action shall be resolved only in a state or federal court located in the County of New York, State of New York. Any and all claims, judgments and awards shall be limited to actual out-of pocket costs incurred and under no circumstances will participants be permitted to obtain awards for and participants hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages other than for actual out-of-pocket costs and all rights to have damages multiplied or otherwise increased.
